What is CAN-SPAM?

The CAN-SPAM Act (Controlling the Assault of Non-Solicited Pornography And Marketing) is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have you stop emailing them, and spells out tough penalties for violations.

Key Point: CAN-SPAM applies to all commercial emails, including business-to-business messages. Each violation can result in penalties up to $50,120.

CAN-SPAM Requirements

1. Header Information

All emails must have accurate "From," "To," and "Reply-To" headers that correctly identify the person or business who initiated the message.

2. Subject Line

The subject line must accurately reflect the content of the message and cannot be deceptive or misleading.

3. Identify as Advertisement

The message must be clearly identified as an advertisement unless the recipient has given prior affirmative consent.

4. Physical Address

Every email must include a valid physical postal address for the sender.

5. Unsubscribe Mechanism

Every email must include a clear and conspicuous explanation of how the recipient can opt out of getting email from you in the future.

6. Honor Opt-Out Requests

You must honor opt-out requests within 10 business days. You cannot charge a fee, require the recipient to give you any personally identifying information beyond an email address, or make the recipient take any step other than sending a reply email or visiting a single page on a website.

7. Monitor Third Parties

Even if you hire another company to handle your email marketing, you can't contract away your legal responsibility to comply with the law.

Penalties for Non-Compliance

Violating the CAN-SPAM Act can result in:

  • Up to $50,120 per email in violation
  • Criminal penalties including imprisonment for aggravated violations
  • Damages and attorney fees to commercial email recipients
